- The rule does not name any technology. Under the amendments adopted in October 2022, a broker-dealer can keep electronic records either in a non-rewriteable, non-erasable format or in a system with a complete time-stamped audit trail that permits re-creation of an original record (SEC, October 2022). An anchored ledger can supply tamper evidence for that audit trail, but the firm still has to meet the rule's other conditions, including immediate production of records to regulators.
- The European Data Protection Board says it is technically demanding and often difficult to honour erasure or rectification requests when clear text, encrypted or hashed personal data sits on a blockchain, so it advises keeping personal data in those forms off-chain (EDPB, July 2026). Enterprise designs therefore keep records and identifiers in systems that can delete them and commit only batch-level integrity proofs to the ledger, bearing in mind that the EDPB treats even a salted hash of personal data as personal data. Under GDPR Article 17(3)(b), erasure also does not apply where EU or member state law requires the data to be kept.
- It depends on who must be able to verify the record. A permissioned ledger suits a closed group of known counterparties that share operating costs and governance. A public chain suits evidence that outsiders, such as regulators or courts, must check without trusting the operator. One workable design keeps data private and publishes only periodic integrity commitments to a public network. The EDPB says organisations should favour permissioned blockchains and explore other governance models only for well-justified, documented reasons (EDPB, July 2026).
